Rules of the ČD Points Loyalty Programme

1. Introductory provisions

1.1. The contents of this document are the rules of the ČD Points Loyalty Programme (hereinafter the “ČD Points programme”), whose operator is the company České dráhy, a.s., Nábřeží L. Svobody 1221/12, 110 15 Prague 1, ID No.: 70994226, Tax ID No.: CZ70994226, registered in the Commercial Registry maintained by the Municipal Court in Prague, Section B, rider 8039 (hereinafter “ČD”), and which is intended for customers of the ČD e-shop.

1.2. The goal of the ČD Points programme is to improve the quality of services provided by the company ČD and to provide rewards to loyal ČD customers.

1.3. The company ČD is authorised to create special promotions for members of the ČD Points programme, about which the members will be informed. The rules of these special promotions will be published on www.cd.cz/cdbody.

1.4. Membership in the ČD Points programme arises through registration with the ČD e-shop, subsequent activation of the ČD Points programme (by filling in an application), confirmation of familiarisation with the terms and conditions of Personal Data Protection, consent to the processing of personal data and agreement to the Rules of the ČD Points Loyalty Programme (hereinafter the “Rules”).

1.5. Access to the ČD Points programme is through the www.cd.cz web interface and the Můj vlak (“My Train”) application.

1.6. Participation in the ČD Points programme is voluntary.

1.7. The ČD Points programme is intended for physical persons 16 years of age or older. Legal persons are not permitted to become members. Customers making use of the advantages of the corporate ČD e-shop do not earn loyalty points.

1.8. The subject of the ČD Points programme are points earned for purchases in the ČD e-shop, on the mobile website and in the Můj vlak (“My Train”) application; points cannot be exchanged for money or benefits other than those offered by the company ČD.

1.9. Points are credited to the account of the customer who is logged into the ČD e-shop and are non-transferable. Points are only credited to customers purchasing in the ČD e-shop, on the mobile website, or in the Můj vlak (“My Train”) application as logged-in users.

1.10. In the event that membership in the ČD Points programme is dissolved or registration in the ČD e-shop is cancelled, the customer shall forfeit all points in his or her loyalty account.

2. Duration of the ČD Points programme

2.1. The duration of the ČD Points programme is not temporally limited. The company ČD, however, reserves the right to terminate the ČD Points programme at any time (see Article 8, point 8.6).

3. Terms of participation

3.1. The ČD Points programme can only be used by customers registered with the ČD e-shop operated on www.cd.cz who have activated the ČD Points programme and have granted consent to the processing of their personal data.

4. Earning points

4.1. The customer can earn points for every purchase of inland and international travel documents including inland and international reservations realised per points 4.2 – 4.5 in the ČD e-shop, on the mobile website or in the Můj vlak (“My Train”) application.

4.2. In the case of inland travel documents, including inland and international reservations, the customer automatically earns 1 point for each CZK 10 spent.

4.3. Types of inland travel documents for which the customer earns points at a rate of CZK 10 = 1 point:

4.3.1. all variants of the IN 100, IN 25, IN 50, IN Důchodce (“IN Pensioner”) and IN Senior applications;

4.3.2. the IN 25 application in combination with a commuter ticket (weekly, monthly or quarterly);

4.3.3. the IN 50 application in combination with a commuter ticket (weekly, monthly or quarterly);

4.3.4. an upgrade to 1st class (one-off upgrade or time upgrade);

4.3.5. a ticket for a one-way or return journey including all combined discounts;

4.3.6. a one-way or return ticket with a global price;

4.3.7. a reservation, SC reservation or railjet Business reservation;

4.3.8. a one-way or return Special-Offer Ticket (Akční jízdenka);

4.3.9. a First Minute Czech Ticket (Včasná jízdenka Česko);

4.3.10. a one-way or return group discount;

4.3.11. an All-Day Ticket (Celodenní jízdenka);

4.3.12. an All-Day Ticket Region (Celodenní jízdenka region) in all variants;

4.3.13. a Group Weekend Ticket (Skupinová víkendová jízdenka);

4.3.14. a Group Weekend Ticket Region (Skupinová víkendová jízdenka region) in all variants.

4.4. In the case of international travel documents without international reservations:

4.4.1. When purchasing an international travel document for a distance of up to 50 km inclusive, the customer earns 5 points.

4.4.2. When purchasing an international travel document for a distance of 51 km or more, the customer earns 10 points.

4.4.3. When purchasing an international ticket with a global price including the SparNight offer, the customer earns 10 points.

4.5. When purchasing a sleeper or couchette supplement, the customer will earn 10 points.

4.6. The customer will not earn points in the case of the following realised purchases:

4.6.1. when purchasing a parking voucher;

4.6.2. when using a transport voucher;

4.6.3. when paying for the transport of luggage, the carriage fee for a dog, or a reservation of a space for a bicycle only; 4.6.5. in the case of a purchased ticket where both the boarding station and the destination station are on the territory of a state other than the Czech Republic;

4.6.4 when recharging an electronic wallet (EPIK) or a ČD Credit account;

4.6.5 if, for any reason, the ticket purchase cannot be completed;

4.6.6 when paying for documents with loyalty points, even on the amount of the co-payment paid to programme partners.

4.7. Earned points are credited to the customer’s loyalty account immediately after making a payment. Points can be used only after the first day of validity of the travel document for which the customer earned the points. The customer has two accounts within the ČD Points programme:

4.7.1. an account with the total point balance containing the total number of points which the customer has earned with his or her purchases, i.e. including points which are not yet available for use (the first day of validity of the travel document for which the points were earned has not passed); this is displayed to the customer as the Current Balance of the loyalty account.

4.7.2. an available account, which contains only those points which the customer can use; this is displayed to the customer as the Available Points in the loyalty account.

4.8. The term of validity of each point is 24 months from the first day on which the customer can use it. Points older than 24 months are automatically erased from the account. Erased points cannot be used subsequently.

4.9. Passengers who purchase travel documents for 1st class on selected trains earn double points.

4.9.1. Passengers earn double points from the total price of the travel document.

4.9.2. A condition for crediting double points to a passenger’s loyalty account is an inspection of the travel document on the specified ČD train.

4.9.3. Double points will be credited to the passenger’s loyalty account no earlier than on the following day and no later than seven days from the day on which the travel document was inspected on the relevant train.

4.9.4. The passenger will not be credited double points if he or she purchases a travel document for a connection other than those specified for the double-points special, but then actually uses one of the specified trains.

4.9.5. Nor will the passenger be credited loyalty points if he or she uses loyalty points when purchasing the travel document.

4.9.6. More detailed information on both special offers is available on the loyalty programme website in the “Special offers” section.

5. Using points

5.1. The customer can use points in the ČD e-shop and in the Můj vlak (“My Train”) application.

5.2. On the basis of his or her earned points, the customer can select a ČD product, which always comes with a 100% discount, or the product of a partner and apply the relevant discount to it (hereinafter also “benefit”). The remaining portion of the price of the benefit must always be paid to the partner by the customer, using a standard payment method. The customer does not earn points for this co-payment.

5.3. The customer can always only use one benefit per purchase. It is not possible to combine benefits.

5.4. Overview of Benefits

5.4.1. In the case of the benefit “Voucher for admission to the Kingdom of Railways (Království železnic)”, a co-payment in the amount of CZK 30 will be paid directly in the ticket office of the Kingdom of Railways museum (Království železnic), Stroupežnického 23, Prague 5.

5.4.2. A condition of the benefit “Voucher for performances at the ABC and ROKOKO Theatres” is the purchase of one ticket for admission; after presentation of this voucher, the customer will obtain a second ticket for admission free of charge. The voucher can be used for tickets for admission to performances of the ABC and Rokoko Theatres’ own productions in the first and second price zones. The voucher cannot be used for the productions Shirley Valentine, Pan Kaplan má třídu rád, Proč muži neposlouchají a ženy neumí číst v mapách or Vím, že víš, že vím.

5.4.3. A condition of the benefit “Voucher for performances at the MeetFactory Theatre” is the purchase of one ticket for admission in advance sales; the second ticket for admission is free of charge. The voucher can be used for performances of the MeetFactory Theatre’s own productions (i.e. those which are not specified in the programme as “Guest” (“Host”)).

5.4.4. A condition of the benefits “Voucher for performances at the HaDivadla Theatre” and “Voucher to Castles and Chateaux” (Cesty za diplomacií) is the purchase of one ticket for admission; after presentation of the specified voucher, the customer will obtain a second ticket for admission free of charge.

5.4.5. The benefit “Voucher for a ČD bicycle rental” includes an overview of bicycle renal facilities where the voucher is valid.

5.4.6. The annual IN 25 benefit in all variants purchased with the help of ČD Points cannot be upgraded to a higher application.

5.4.7. For the benefits “45% discount on a subscription to titles from the Burda Praha publishing house” and “CZK 100 discount on purchases over CZK 800 at Knihcentrum.cz”, the code can only be applied electronically on the partners’ respective websites.

5.4.8. For the benefit “Voucher for a performance at the National Theatre in Brno”, it is possible to apply a discount in the amount of 30% at performances from the repertoire of the National Theatre in Brno at the ticket counters in the Customer Centre (Zákaznické centrum, Dvořákové 11), or at any evening ticket counter at the Theatre’s performance venues.

5.4.9. For the benefit “Voucher for a performance at Městské divadlo Brno”, a discount in the amount of 50% can be applied for at most two tickets for admission. The voucher cannot be applied at the evening ticket counters, for premieres, for performances already purchased or for guest performances.

6. Terms and conditions for cancellations and the influence of exercising one’s right under the transport contract on the status of the loyalty account

6.1 From the perspective of provided benefits, it is not possible:

6.1.1. to cancel a voucher for admission to the Kingdom of Railways (Království železnic) procured for loyalty points; the voucher is issued with a 3-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.2. to cancel a voucher for admission to the Railway Museum in Lužná u Rakovníka procured with loyalty points; the voucher is issued with a 12-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.3. to cancel a voucher for a performance at the ABC and ROKOKO Theatres, the HaDivadla Theatre, the National Theatre in Brno, Městské divadlo Brno or for Castles and Chateaux (Cesty za diplomacií) procured with loyalty points; the voucher is issued with a 3-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.4. to cancel a voucher for a ČD bicycle rental; the voucher is issued with a 12-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.5. to cancel a voucher for a performance at the MeetFactory Theatre procured with loyalty points; the voucher is issued with a 6-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.6. to cancel a voucher for a 25% discount on the “Experience the Žďár nad Sázavou Castle” package or the voucher for a 25% discount on admission to the New Generation Museum at Žďár nad Sázavou Castle procured with loyalty points; the vouchers are issued with a 6-month term of validity; if the customer does not use it during the given term, the voucher is forfeited without compensation;

6.1.7. to cancel a voucher for a discount on a subscription to titles from the Burda Praha publishing house or a voucher for a discount on purchases at Knihcentrum.cz.

6.2. In the event that the customer’s right under the transport contract is exercised on a travel document purchased in the full amount by means of a standard payment method (payment card), it is only possible to exercise the request in the ČD e-shop. Submitting a request for a refund of a travel document (in part or in full) will result in the deduction (in part or in full) of the points earned for the purchase of the travel document in the extent specified in points 6.3 and 6.4. In the event of a subsequent rejection of the refund on the side of the company ČD, these deducted points will be re-credited to the customer’s loyalty account.

6.3. Exercising one’s right under the transport contract (filing a claim) for reasons on the passenger’s side

6.3.1. In the event of an exercised right under the transport contract (claim) for reasons on the passenger’s side, all points earned for the purchased travel document will be deducted upon submission of the request. In the event of a positive settlement of the exercised right (claim), the points will remain deducted; if the service charge is equal to or greater than the recognised sum, then the refund will equal CZK 0. If the claim is rejected, the points will be returned to the passenger’s loyalty account.

6.3.2. If a one-way or return ticket was paid for with loyalty points, then all points used will be returned if a completely unused document is returned up until 15 minutes prior to the beginning of the document’s term of validity. In other cases, the service charge is 100% of the applied loyalty points.

6.3.3. In the case of a network ticket procured for loyalty points, for purchases made outside the Search Connections module the full number of points are returned when a right under the transport contract is exercised by 23:59 (11:59 p.m.) on the day preceding the first day of validity; if the return is made by 8:00 (a.m.) on the first day of validity for such purchases, 50 ČD Points are returned. If the document is purchased through the Search Connections module, all points are returned in the event of a return until 15 minutes prior to the beginning of the document’s term of validity (even after 8:00 (a.m.)).

6.3.4. In the event that a seat reservation is procured with loyalty points, the full number of points are returned when a right under the transport contract is exercised until 15 minutes prior to the beginning of the document’s term of validity,

6.3.5. If an In Karta card application or upgrade to 1st class is procured and paid for with loyalty points, the service charge is 10% of the ČD Points in the event of a return until and including the first day of validity. In the case of a request to return an In Karta card where the card is in production or has been produced, the service charge is 50% of the ČD Points.

6.4. Exercising one’s right under the transport contract for reasons not on the passenger’s side

6.4.1. In the event of an exercised right under the transport contract (claim) for a reason not on the passenger’s side, all points earned for the purchased travel document will be deducted. In the event of a positive settlement of the exercised right (claim), the points will remain deducted. In the event of a partial refund, points will be returned for the line travelled. If the claim is rejected, the points will be returned to the passenger’s loyalty account.

6.4.2. If the document was paid for with loyalty points, the used points will be returned in the full amount in the event of either complete or partial non-use of the travel document.

7. Revocation of points

Earned points will be revoked from the customer’s loyalty account in the following cases:

7.1. the points were earned due to a mistake or technical error in the system;

7.2. the points are linked to a transaction which has been cancelled for any reason;

7.3. the customer has abused the mechanism and/or benefits of the ČD Points loyalty programme;

7.4. the customer acted without authorisation or in contravention of good morals.

8. Final provisions

8.1. Membership in the ČD Points programme and all rights connected therewith are non-transferable, are dissolved with the death of the member of the ČD Points programme, and therefore cannot be the subject of a right of inheritance. Membership is also dissolved if any the conditions of participation specified in Article 3, point 3.1, of these Rules should cease to apply. At the moment of dissolution of membership in the ČD Points programme, all unused points are forfeited without compensation.

8.2. The current wording of the Rules is available on www.cd.cz/cdbody.

8.3. These Rules are valid from 19 May 2018.

8.4. Customers will be informed of any changes to the Rules on www.cd.cz/cdbody.

8.5. The company ČD reserves the right to change and modify the Rules as needed, as well as the benefits themselves including the number of earned points and the percentage amount of the discounts. Customers will always be informed of these changes at least one month prior to the change taking effect on www.cd.cz/cdbody. In the event that in the future a lesser number of points should be required for a particular benefit, the customer shall not have a right to compensation if he or she has already drawn the benefit per the then valid Rules.

8.6. The company ČD has prepared the ČD Points programme with long-term intent. However, the company ČD reserves the right to terminate the ČD Points programme at any time. The termination date of the ČD Points programme will be published on http://www.cd.cz/cdbody at least two months in advance. After the termination date of the ČD Points programme, points will no longer be allocated. It will be possible to redeem benefits for points earned prior to the termination date of the ČD Points programme per the last effective wording of the Rules no later than 90 days following the termination date of the ČD Points programme.
